Al G7 Privacy, che si è concluso a Roma venerdì scorso, Key4biz ha intervistato, one to one, Wojciech Wiewiórowski, il Garante Privacy europeo. Ecco l’intervista completa in italiano e a seguire in inglese.
Key4biz. Stiamo vivendo la Privacy nell’era dei dati, ma siamo anche nell’era dell’AI. Qual è il ruolo del Garante Europeo per la Protezione dei Dati per bilanciare l’uso dell’AI con i diritti e le libertà delle persone?
Wojciech Wiewiórowski. Il Garante Europeo per la Protezione dei Dati, oltre a essere il Supervisore delle Istituzioni europee in materia di protezione dei dati, è il principale interlocutore nel processo legislativo dell’UE. Quindi il nostro ruolo è principalmente quello di rappresentare il rispetto della privacy e della protezione dei dati durante tutti i lavori su qualsiasi tipo di legge dell’Ue e dopo, anche durante la sua attuazione.
Key4biz. Qual è la sua opinione sull’AI Act?
Wojciech Wiewiórowski. All’inizio avevo molti dubbi sull’AI Act. Non riuscivo a capire quale fosse il vero ruolo di questo Regolamento. Ma devo dire che sia la proposta della Commissione che i successivi lavori in Consiglio e in Parlamento dimostrano che c’è un’idea su come gestire l’intelligenza artificiale. Un’idea che non si pone dal punto di vista dei diritti fondamentali, bensì, principalmente, dalla prospettiva della sicurezza dei prodotti e dei servizi, che è, a mio avviso, il giusto approccio a qualcosa che deve funzionare sul mercato e deve dare i suoi vantaggi, perché l’AI è sicuramente una delle opportunità per la nostra società.
Key4biz. E qual è il ruolo dell’EDPS secondo l’AI Act?
Wojciech Wiewiórowski. Innanzitutto il Garante Europeo per la Protezione dei Dati supervisiona le Istituzioni europee in merito all’uso dell’AI. Istituzioni che, ovviamente, non producono soluzioni di Intelligenza Artificiale che poi vengono vendute sul mercato, ma le impiegano. Le utilizzano anche per il lavoro delle Istituzioni europee. Quindi il nostro ruolo sarà principalmente di vigilanza, ma più come Autorità di sorveglianza del mercato che come Autorità di protezione dei dati. Allo stesso tempo, manteniamo il nostro ruolo di Garante [AF1] per la protezione dei dati.
Key4biz. Infine, secondo lei, con chi si dovrebbe collaborare e discutere per avere un’AI sicura, affidabile ed etica?
Wojciech Wiewiórowski. Questo dialogo dovrebbe essere molto ampio, coinvolgendo molti stakeholder, perché dobbiamo ricordare che non esiste un solo settore che si occupa di AI. E ora, in realtà, tutti i sistemi informativi utilizzano in qualche modo l’intelligenza artificiale. Quindi dobbiamo pensare a ciascuna soluzione IT come una possibile sede per le soluzioni di AI. Dobbiamo quindi collaborare non solo con gli scienziati, non solo con l’industria, ma anche con coloro nei cui mercati e nei cui lavori verrà usata l’AI.

Interview with Wojciech Wiewiórowski (the European Data Protection Supervisor): “I had quite a lot of doubts at the beginning about AI Act, but now it has the right approach to deal with AI”
Wojciech Wiewiórowski: “On the AI Act, our role will be mainly one of supervision, but more as a Market Surveillance Authority than as a Data Protection Authority. At the same time, we maintain our role as Data Protection Supervisor”.
At the G7 Privacy, that concluded in Rome last Friday, Key4biz – with its editor-in-chief Luigi Garofalo – interviewed Wojciech Wiewiórowski, the European Data Protection Supervisor.
Key4biz. We are leaving the Privacy in the data era, and we are also in AI era. What is the European Data Protection Supervisor’s role to balance the use of AI with people’s rights and freedoms?
Wojciech Wiewiórowski. European Data Protection Supervisor, apart from being supervisor of the EU institutions as far as data protection is concerned, is the main advisor in the legislative process in the EU. So, our role is mainly to represent those whose privacy shall be observed during all works on any kind of law that is prepared by the EU, and also then in the implementation of it.
Key4biz. What is your opinion about the AI Act?
Wojciech Wiewiórowski. I had quite a lot of doubts at the beginning about the AI Act. I couldn’t understand what the real role of this Act was. But I have to say that both the proposal of the Commission and then the works in the Council and in the Parliament show that there is an idea how to deal with it. Idea which is not taking it from the fundamental rights point of view, but mainly from the product safety and service safety perspective, which is, I think, the good approach to something which should work on the market and should give its pluses, because AI is definitely one of the opportunities for our society.
Key4biz. And what is EDPS’ role according to the AI Act?
Wojciech Wiewiórowski. First of all, the European Data Protection Supervisor is supervising the EU institutions as far as the use of AI is concerned. So, of course, they are not producing AI solutions that are then sold on the market, but they are deploying them. They are also using them for the work of the EU institutions. So, our role will mainly be the supervisory role, but rather as a market surveillance authority than as a data protection authority. At the same time, we still keep our role of the Data Protection Supervisor.
Key4biz. Lastly, in your opinion, with whom should there be a collaboration and discussion to have a safe, trustworthy and ethical AI?
Wojciech Wiewiórowski. It has to be very, very broad, because we have to remember that there isn’t only one industry dealing with AI. And now, actually, all the information systems in some way use AI. So, we have to think about each of the IT solutions as the possible seat for the AI solutions. So, we need to cooperate not only with the scientists, not only with the industry, but also with those in whose markets, in whose works the AI and the results of its work will be used.
